Welcome to TributeToMyPet, a service provided by October Wolf LLC. These Terms and Conditions govern your use of our website, services, and products, including the creation of pet memorial and celebration books.

By uploading photos, creating a preview, placing an order, or otherwise using our service, you agree to these terms. If you do not agree, please do not use the service.

We've tried to write these terms in language that doesn't require a solicitor to decode. Where legal precision is unavoidable, we've said so. The goal is that you finish this page knowing exactly where you stand, and feeling, correctly, that we've nothing to hide.

Who We Are

TributeToMyPet is operated by October Wolf LLC, a company registered in the United States. References to "we," "us," or "our" throughout these terms mean October Wolf LLC. References to "you" mean any person who accesses or uses our service.

Changes to These Terms

We may update these terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where reasonable, notify existing customers by email. Your continued use of the service after any update constitutes acceptance of the revised terms. If you disagree with a change, you may stop using the service.

Eligibility

To use TributeToMyPet you must be at least 18 years of age, or the legal age of majority in your jurisdiction if that is higher. By using the service, you confirm that you meet this requirement.

What You Upload

When you use TributeToMyPet, you upload photographs of your pet. By uploading photos, you confirm that:

• You own the photos, or have the right to use them for this purpose.
• The photos do not infringe the copyright or other rights of any third party.
• The photos do not contain material that is unlawful, obscene, or harmful.
• You are authorised to share the photos with us for the purposes described in these terms.

How We Use Your Photos

Your photos are used solely to create your pet's portrait book. Specifically, we use them to study your pet's specific characteristics, their markings, colouring, facial structure, and expressions, so that the portraits we generate are unmistakably of your animal, not a generic substitute.

We do not use your photos to train general-purpose models that will be used for other customers. We do not sell your photos. We do not share your photos with third parties except as required to generate your book.

Photo Retention

Uploaded photos are retained for a period necessary to generate your book and support any remake requests or quality queries. Following completion of your order and expiry of any applicable remake or refund window, photos are deleted from active systems on a rolling basis. Full details are in our Privacy Policy.

Photo Quality

We accept photos of any quality, including low-resolution, poorly lit, or slightly blurry images. You do not need professional photography. The minimum requirement is that the photos clearly show your pet in enough detail for us to identify their specific characteristics. We will advise you if the photos provided are insufficient to produce a result we're confident in.

The Free Preview

Before any payment is required, we generate a preview of your pet's portrait book and make it available for you to view. This preview is provided at no charge. No credit card is required to receive a preview. This is not a trial with a paywall behind it, it is a genuine opportunity to see your pet's portraits before deciding whether to purchase.

Previews are typically ready within one hour of photo upload. During periods of high demand, this may take longer. We will notify you by email when your preview is ready.

How Portraits Are Created

Your pet's portraits are created using a generation process that studies the photos you have provided. Each portrait places your pet in a curated scene, lakesides, autumn trails, meadows, firesides, rendered in a photorealistic style. The portraits are original creations made specifically for your pet. They are not stock images, templates, or generic animal illustrations.

Because each portrait set is created from scratch for your specific animal, results will vary based on the quality and variety of photos provided. More varied photos (different angles, lighting conditions, expressions) generally produce better results.

Remake Policy

If your preview does not look sufficiently like your pet, or if you are dissatisfied with the portraits for any reason, please contact us before placing an order. We will assess your feedback and, where reasonable, generate a new set of portraits. There is no charge for a remake request prior to ordering.

Scenes and Settings

Scenes are selected by us from a curated library designed to show pets in their best light. We do not currently offer the ability to request specific scenes as part of the standard order process. If you have particular requirements, please contact us before uploading and we will discuss what may be possible.

No Guarantee of Specific Results

While we make every effort to produce portraits that are accurate and beautiful, portrait generation involves a degree of creative interpretation. We cannot guarantee that every portrait will capture every nuance of your pet's appearance. What we can guarantee is that we will not consider the process complete until you are satisfied, or until we have exhausted reasonable efforts to achieve that.

Placing an Order

An order is placed when you complete the checkout process and payment is successfully taken. By placing an order, you confirm that:

• You have reviewed your preview and are satisfied with the portrait quality.
• The details you have provided (name, shipping address, email) are accurate.
• You are authorised to make payment using the payment method provided.

Order Confirmation

You will receive an email confirmation when your order is placed. If you do not receive a confirmation within 30 minutes of ordering, please check your spam folder and, if necessary, contact us. An absence of confirmation email does not mean an order was not placed, please verify with us before re-ordering to avoid duplicates.

Multiple Copies

You may order additional copies of your pet's book. Additional copies use the same portraits as your original order. Each copy is physically printed and shipped separately. Pricing for additional copies is shown at checkout.

Multiple people may grieve the same pet. Additional copies are a way of sharing a memorial with others who loved the same animal, not a duplication of a product but a widening of who receives it.

Order Amendments

Because your book enters production shortly after ordering, we have a limited window in which amendments can be made. If you need to change a shipping address or any other detail, contact us as soon as possible after ordering. We will do our best to accommodate changes but cannot guarantee this once printing has begun.

Order Cancellation

You cannot cancel your order once an order has been place as it immediately enters print production. That is why the DRAFT Review process is in place.

Pricing

All prices are displayed at checkout in US Dollars. Prices are subject to change. Any change in pricing will not affect orders already placed. Customers outside the United States may incur additional currency conversion fees from their payment provider, which are outside our control.

Payment Processing

Payments are processed by a third-party payment provider. We do not store complete card details on our servers. Your payment information is subject to the terms and privacy policy of our payment processor. We accept major credit and debit cards as indicated at checkout.

No Subscription

TributeToMyPet operates on a single-purchase basis. There are no subscriptions, no recurring charges, and no automatic renewals. Each order is a standalone transaction. You will never be billed again unless you choose to place a new order.

Failed Payments

If a payment fails, your order will not be placed. You will be notified and invited to try again. If a payment is authorised but your order is not confirmed, please contact us immediately so we can investigate.

Fraudulent Transactions

We reserve the right to cancel orders where we have reasonable grounds to believe a fraudulent transaction has occurred, and to report such transactions to relevant authorities. Chargebacks initiated without first contacting us to resolve a complaint in good faith may result in the matter being referred for investigation.

Estimated Delivery Times

Orders are typically delivered within 2-3 weeks of being placed. This window covers portrait finalisation, professional printing, hardcover binding, and shipping. Delivery times are estimates, not guarantees. Factors outside our control, including carrier delays, customs processing for international orders, and exceptional demand periods, may extend this window.

Shipping Address

Please ensure your shipping address is accurate at the time of ordering. We ship to the address provided at checkout. We cannot be held responsible for non-delivery resulting from an incorrect or incomplete address. If you notice an error in your shipping address after ordering, contact us immediately.

International Shipping

We ship worldwide. International orders may be subject to customs duties, import taxes, or other fees levied by the destination country. These charges are the responsibility of the recipient and are not included in our pricing. We have no control over customs processing times, which may add to the delivery window.

Tracking

Once your order ships, you will receive a tracking number by email. This allows you to monitor your delivery through the carrier's own tracking system.

Gifting

You may ship a book directly to a gift recipient by entering their address at checkout. No pricing information or invoice is included inside the package.

Damaged or Lost Shipments

If your book arrives damaged, please photograph the damage and contact us within 14 days of delivery. We will arrange a replacement or refund at no additional charge. If your tracking shows a book as delivered but you have not received it, please first check with neighbours and your local carrier, then contact us. We will do our best to resolve the situation.

Full Refund Eligibility

A full refund will be issued if:

• Your book arrives physically damaged through shipping.
• Following a remake, you remain dissatisfied with the result.
• Your book is lost in transit and we are unable to resolve this with the carrier.
• We are unable to produce a book that meets a reasonable standard of likeness to your pet.

Refund Process

Refunds are issued to the original payment method within 5-10 business days of approval.

Change of Mind

Because each book is a custom-created product made specifically for your pet, we are not able to accept returns based purely on change of mind once production has begun. The free preview process exists precisely so that you can make a considered decision before any money changes hands. If something in the physical book differs from your approved preview in a meaningful way, that is a different matter and is covered by our remake and refund policy above.

Your Photos

You retain full ownership of the photos you upload. Uploading photos to our service does not transfer any ownership rights to us. You grant us a limited, non-exclusive licence to use your photos solely for the purpose of generating your portrait book and providing the service described in these terms. This licence terminates when your order is complete and any applicable support or remake window has closed.

The Portraits and Book

Upon full payment and delivery, you are granted a personal, non-commercial licence to use the portraits and the book content. You may display the book in your home, share photographs of it on personal social media, and gift physical copies to others.

You may not reproduce the portraits for commercial purposes, sell or licence the portrait imagery to third parties, or use the portraits in a way that could be confused with our own marketing materials without our prior written consent.

Our Content

All other content on the TributeToMyPet website, including copy, design, imagery, and branding, is owned by October Wolf LLC and protected by applicable intellectual property law. You may not reproduce or use this content without our written permission.

DMCA and Copyright Complaints

We respect intellectual property rights. If you believe any content on our platform infringes your copyright, please contact us at the address in the Contact section with the following information:

• A description of the copyrighted work you believe has been infringed.
• A description of where the infringing material appears on our platform.
• Your contact details.
• A statement that you have a good faith belief the use is not authorised.
• A statement, under penalty of perjury, that the information is accurate and you are authorised to act on behalf of the copyright owner.

We will respond to valid DMCA notices within 7 business days.

Your privacy matters to us. The short version: we collect only what we need, we use it only for the purposes described, and we don't sell it.

What We Collect

To provide the service, we collect your email address, your pet's photos, your shipping address, and payment information (processed by our payment provider, we do not store complete card details). We may also collect basic usage information to improve the service.

How We Use It

We use your information to generate your preview, process your order, ship your book, and communicate with you about your order. We may send you occasional emails about new products or offers from TributeToMyPet. You may opt out of marketing emails at any time.

Who We Share It With

We share your data only with service providers who assist in delivering your order, including our print and fulfilment partner, our payment processor, and our portrait generation infrastructure. These providers are contractually bound to use your data only for the purposes we specify.

We do not sell your personal data. We do not share it with advertisers.

International Data Transfers

Your data may be processed on servers located outside your country of residence. Where this involves transfers from the European Economic Area, we ensure appropriate safeguards are in place in accordance with applicable data protection law.

Your Rights

Depending on your jurisdiction, you may have rights to access, correct, or delete the personal data we hold about you. To exercise these rights, contact us at the address in the Contact section.

Cookies

We use cookies and similar technologies to operate and improve our website. By continuing to use our site, you consent to our use of cookies as described in our Privacy Policy.

Service Availability

TributeToMyPet is provided on an "as available" basis. We do not guarantee that the service will always be available, uninterrupted, or error-free. We will endeavour to notify you of planned maintenance or outages where possible.

Limitation of Liability

To the maximum extent permitted by applicable law, October Wolf LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the service.

Our total liability to you for any claim arising out of or relating to these terms or the service shall not exceed the amount you paid for the order in question.

Force Majeure

We will not be liable for failure to perform our obligations where such failure is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, governmental actions, carrier failures, or significant disruptions to internet infrastructure. We will notify you as soon as reasonably practicable and endeavour to resume performance as quickly as possible.

Third-Party Services

We use third-party services to provide parts of our service, including payment processing, print fulfilment, and infrastructure. We are not responsible for the acts or omissions of third-party providers beyond our reasonable control. Where a third-party failure affects your order, we will do our best to resolve the situation, but our liability remains limited as described above.

User Responsibilities

You agree to use the service only for lawful purposes. You agree not to attempt to circumvent any security measures, interfere with the service's operation, or use the service in a way that could harm others. Violations may result in termination of your access to the service.

Indemnification

You agree to defend, indemnify, and hold harmless October Wolf LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your conduct, uploaded content, violation of any third-party rights, breach of these terms, or misuse of the service.

Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Washington State, USA. October Wolf LLC reserves the right to modify the governing law and jurisdiction at its discretion.

Dispute Resolution

In the event of a dispute, we encourage you to contact us first. The vast majority of concerns can be resolved quickly and to mutual satisfaction through direct communication. We are not a faceless organisation - there are real people here who care about getting things right.

Changes to Terms

October Wolf LLC may update these terms at any time at its discretion. Updates become effective upon publication on this page. Your continued use of the service after any update constitutes acceptance of the revised terms.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and October Wolf LLC with respect to the service. They supersede any prior agreements or representations, whether oral or written.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms continue in full force and effect.

No Waiver

Our failure to enforce any provision of these terms on any occasion does not constitute a waiver of our right to enforce that provision in the future.

Electronic Communications

By using our service, you consent to receiving communications from us electronically, including by email. You agree that electronic communications satisfy any legal requirement for written communications.

Assignment

You may not assign your rights or obligations under these terms to any third party without our prior written consent. We may assign our rights and obligations, for example in the event of a merger, acquisition, or sale of assets, provided that such assignment does not materially diminish your rights under these terms.

Survival

The following sections survive the termination of your account or any order: Ownership and Intellectual Property, Privacy and Data, Liability, and Legal Matters.

Export Controls

You agree to comply with all applicable export control laws and regulations. Our service is not available in territories subject to US sanctions or where prohibited by applicable law.
